Section 504
Section 504 of the Rehabilitation Act of 1973 protects the rights of individuals with disabilities in programs and activities that receive federal funds. Section 504 provides that: “No otherwise qualified individual with a disability in the United States… shall, solely by reason of his or her disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance…” [34 C.F.R. §104.4(a)]
Campus Section 504 Committees' goal is to identify students who meet eligibility criteria for Section 504 services and develop appropriate individual accommodation plans, positive behavior support plans and/or provide services as needed to meet the individual needs of qualified students with disabilities. The main emphasis in the schools is to provide equal educational opportunities to students with disabilities to the same extent that the needs of non-disabled students are met.
